Sereno’s P17-M Piatco fees ‘illegal’

The Court of Appeals Special 11th Division on Monday, June 4th has declared and considered as ‘illegal’ the Attorney’s Fees that the former Chief Justice Maria Lourdes Sereno and her affiliates amassed a total of $6 Million for handling the International Arbitration Case between the Philippine government and contractor of the Ninoy Aquino International Airport (NAIA) Terminal 3.
Philippine International Air Terminals Co., Inc. (PIATCO) had earlier filed for a motion of reconsideration through the ruling of the 17th Division Clerk of Court which then reversed as the services of the late Supreme Court Associate Justice Florentino Feliciano along with Sereno, his former aide, and other associates were perceived to be obtained without proper expenditure appropriation and public bidding.

Due to irregularities, the Commission on Audit (COA) dismissed the budget since court record showed that Sereno earned P17 Million or $324, 674.37 out of the $6,009,351.66 total payment with which the government gained 15%, leaving Sereno a take home pay of $275,973.21 equivalent to about P14.5 Million.

The 50 – page amended resolution authored through the agreement of Justices Rodil Zalameda and Samuel Gaerlan, and Associate Justice Ramon Bato which affirmed the verdict of Mandaluyong Regional Trial Court (RTC) Branch 213’s Judge Carlos Valenzuela.
The Arbitration costs and expenditures as ruled out, were obtained unfortunately, in violation of government policy requiring public bidding and the “long-standing policy against the incurrence of irregular, unnecessary, excessive, extravagant, or unconscionable expenditures or use of funds and property by the government.”

Furthermore, the previous ruling authored by Associate Justice Marlene Gonzales-Sison for the 17th Division, dated January 20, 2017, authorized the petition of the Office of the Solicitor General (OSG) to expedite the payment for Sereno’s legal fees and co – counsels hired by the Philippine government.

As Sereno’s case escalated to the 11th Division, PIATCO asked Sison to take her hands off the case mainly because of “her close association with a personality whose interest is adverse to PIATCO’s position,”

Consequently, 6 other justices of the Court of Appeals impeded from the case prior to Sereno’s ouster through quo warranto proceedings which eventually rendered to her demise.
