Antonio P. Contreras sought to teach the public about quo warranto through his Facebook post in order to clear up any misconceptions, fallacies and anything alike in between. In this particular post, he informed the public that there are only two parties that can file a petition for quo warranto of the Chief Justice.

The one of these parties would be the State, through the representation and prosecution of Solicitor General Jose Calida. A right of the solicitor general. The other party would be “an individual whose right to a position was denied when the person being petitioned improperly occupied the post.”


With that being said, Contreras clarified that the eight justices that didn’t vote for Chief Justice Maria Lourdes Sereno have no right to file a petition for quo warranto against her. 

The only three people who could would be the aforementioned Solicitor General and the two justices who were nominated as Chief Justice back in May 2017, JJ Reyes and Gemundo.



The filling of a petition for quo warranto is a right that was given to these nominated based on what the quo warranto prescribes as Contreras stated,

“Quo warranto prescribes one year after the cause for removal arose, or if there is an individual petitioner, one year after the right of that petitioner to the contested position arose.”

The political analyst ended his post dedicating this to the retiring Justice de Castro, who was, by his words, “the most hated Justice by the pro-Sereno camp.

Now, for those saying that quo warrantos be filed against the 8 justices who voted against Sereno. Only Calida can initiate a petition on behalf of the state. And only those who were nominated to fill vacancies from May 2017 but were not appointed can file petitions as individuals against those appointed after that time. These would be JJ Reyes and Gesmundo. Otherwise, the period for filing by individual petitioners has prescribed for all the other justices.



And that goes for the most hated Justice by the pro-Sereno camp, Justice de Castro, who is retiring before the end of the year."
