According to Law Experts 'Martial Law or No Martial Law, Duterte has duty to Safeguard the Philippines'

A law expert, said martial law has no effect on the military's operations in Mindanao.

Martial law or no martial law, President Rodrigo Duterte has a duty to safeguard the Philippines.

According to the law expert "It's the duty of the President to continue safeguarding the Republic. So even if martial law is lifted, there is nothing to prevent him from commanding military operations to continue against the Maute group and other troublesome groups."

He also added that the President is privy to intelligence reports not available to ordinary citizens, and it is in his power to decide what to do in certain situations.

Duterte placed the entire island of Mindanao under martial law on May 23, following the attack of Islamic State-linked group Maute in Marawi City. It has been 43 days since he declared Martial law in Mindanao, but it seems that the rebels are still willing to die fighting the government troops.

Now, that the Supreme Court (SC) upheld the validity of the proclamation of martial law, or Proclamation 216. 

During the (full court) session, the high court, voting 11-3-1, dismissed the petitions filed by House of Representatives’ minority bloc, residents of Mindanao and women from Marawi. “The Court dismissed the petitions by a vote of 11 of its members,” the high court said.

The decision was issued on the 43rd day of the declaration of martial law.

Should an extension for the proclamation be sought, law expert said the decision is for Congress to make, but it may be challenged before the Supreme Court.

He also said that should Duterte find new grounds and receive new information not yet present to the SC, there is nothing stopping him from declaring martial law again.
